摘要
“百年大计，教育为本”.教育在我国社会主义现代化建设进程中具有基础性、先导性的作用，教师是教育活动最重要的主体，教师队伍素质能力的高低关乎我国1工作积极性去不断提高自身能力素质。随着我国教育法律法规的逐步完善和依法治国、依法治教政策的贯彻落实，教师合法权益的保护和救济制度逐渐受到关注，但是实际效果仍不容乐观。本文立足于我国中小学教师权益保障问题的研究，通过调查多种渠道了解我国教师合法权益保护的现状，分析总结教师沦为“权益弱势群体”
的原因主要涉及校长负责制下的权力越位和监督缺失、教育法规的相关条例可操作性不足、社会舆论环境的偏颇以及教师自身权益意识淡薄，针对这些问题，本文提出要构建完善的教师权益保障体系，关键应从建立健全校长权利制约监督机制、完善教师权益保障法律体系、引导正面社会舆论环境、加强法律宣传学习及增强教师权益意识和法律素质等方面着手，建立完善的教师权益保障体系，提髙教师权益保护的实效性。
本文的创新之处在于通过实地访谈、问卷调查、日常互动交流等方式，走进教师群体真实的生活，坚持“以人为本”的人性研究，总结鲜活真实的个例背后共性的现象和问题，从而力争使收集的资料和数据更具真实性、科学性和直观性。

Abstract
“Education is a cause of fundamental importance for the future of our nation”.
Education plays a foundational, guiding role in the process of socialist modernizationconstruction in our country, the teacher is the most important on subject of educationactivity, quality and ability of teachers about our high education quality and the rights ofteachers group maintenance is direct relation whether the teachers will be motivatedenough to constantly improve their ability and quality. With the development ofeducational laws and regulations of China and the gradual improvement of the rule oflaw administering education policy implementation, teachers' legal rights protection andrelief system attracts more and more attention, but the actual effect is not optimistic. Inthis paper, based on the study of middle and primary schools of our countiy securityinterests of teachers, through the investigation of various channels to understand thecurrent situation of China's teacher's legitimate rights and interests protection, analyzedand summarized the teachers become the reason for the “rights and interests ofvulnerable groups” mainly involves the relevant regulations of the headmaster'sresponsibility system under the power offside and lack of oversight, educational laws andoperability deficiency,public opinion environment biased and teachers' rightconsciousness, aiming at these problems, this paper puts forward to build system ofperfect protecting teachers' rights and interests, the key should establish effective supervision mechanism, improve the teachers' rights legal system, protect the rights andinterests of guiding the public opinion environment positive energy, strengthening thelegal propaganda and learning to enhance the teachers' consciousness of rights and legalquality the aspects such as the establishment of the system of protection of the rights andinterests of teachers, improve, improve the effectiveness of the teachers' rights andinterests protection.
Innovation of this paper is mainly through field visits, questionnaire, dailyinteraction way, into the group of teachers in real life, adhere to the “people-oriented,human study” phenomenon and problems in the real case of fresh behind in common, soas to strive to make the collection of datum and the data is more authentic,scientific andintuitive.
