随着国际投资的发展，大量资金和技术投放到世界各国和地区，不仅促进了有关国家的经济技术发展，而且对整个世界的经济增长和国际分工与合作都起着重大作用。然而，文化遗产作为东道国的公共利益，在新时期的国际投资活动过程中，在很大程度上不断受到冲击和挑战。我国不仅是一个文化遗产大国，而且是国际投资的东道国，同时也是一个资本输出大国。在外国投资者利益与东道国文化遗产保护利益发生冲突时，都无法置身事外。
怎样缓解外国投资者利益与东道国公共利益之间的冲突？以及如何保护东道国的文化遗产？各国政府正面临一个进退两难的窘境。本文通过几个主要案例进行全面分析，分别对国际投资仲裁制度与东道国文化遗产保护措施进行相关完善，以此借鉴他国在文化遗产保护工作方面的经验，并为我国以后的文化遗产保护工作提供一些新启示。
本论文共分为六部分，第一章是引言。第二章是对当前的外国投资者利益与东道国文化遗产保护利益冲突现状进行研究与分析，对国际投资法视野下文化遗产难以保护的原因作出归纳。第三章则是通过三个典型的国际案例来说明东道国文化遗产保护利益在国际投资仲裁庭上处于劣势地位，从而提出 ADR 机制与阶段性保护措施。第四章是完善国际投资法视野下文化遗产保护的措施。第五章是对我国的启示。也就是在国际投资法视野下我国文化遗产保护存在的几个主要法律问题和我国文化遗产保护的四点建议。最后一章是结论。

Abstract
With the development of international investment, significant financial resourcesand technology should be devoted to countries and regions of the world, not onlypromotes economic and technological development of the States concerned, but alsofor the entire world economic growth and international division of labor andcooperation have played an important role.However, as the host country of thecultural heritage and public interests, and in the course of international investmentactivities in the new era, in large part, on challenges and constantly under attack. Ourcultural heritage is not only a country, but also host the international investment, aswell as a large exporting country. In the interests of foreign investors and the hostcountry's cultural heritage protection was a conflict of interest, are unable to stay outof it.
How to balance the interests of foreign investors and host countries conflictsbetween public interests? And how to protect the cultural heritage of the host country?
The Governments are facing with a dilemma. Comprehensive analyses throughseveral major cases, respectively, the international investment arbitration and theprotection of cultural heritage of the host country measures related to perfect, whichother countries ' experiences in cultural heritage protection work, and work forChina's cultural heritage protection after some new revelation.
This paper is divided into six parts, the first chapter is an introduction. Chapter IIis the current interests of foreign investors and host country cultural heritageconservation research and analysis on conflict of interest, for the protection ofcultural heritage from the perspective of international investment law is difficult toreason to sum up. Chapter is illustrated by three typical cases of international culturalheritage protection of interests of the host country at a disadvantage in internationalinvestment arbitration court, and ADR mechanisms and periodic protection measures.
Fourth chapter, we set out to perfect the international investment law under the viewof cultural heritage protection measures. The fifth chapter is the revelation to China.
That in view of international investment law under several main legal issues inChina's cultural heritage protection and cultural heritage protection in China of afour-point proposal. The final chapter is the conclusion.
