摘要
职业教育是国民教育体系重要组成部分,作为职业教育人才培养模式,校企合作对于培养高素质技术技能人才具有不可替代的作用。党和政府制定一系列政策文件鼓励校企合作,职业院校也纷纷与企业开展合作,联合培养人才。然而,我国目前职业教育校企合作普遍存在合作模式单一、合作层次浅、企业缺乏积极性、政府职责不清、参与主体权利与义务不明确、实习学生维权困难等问题,这些制约校企合作的开展,限制职业教育人才培养能力的提升。
本文釆用实地调研、文献分析、对比分析等研究方法,分析校企合作法律法规,力求从法律制度层面破解校企合作难题。首先,运用调查研究方法,通过访问校企合作相关主体,厘清校企合作面临的主要问题和困难,在此基础上,梳理并分析我国中央与地方校企合作法律法规,探究法律制度缺失对校企合作的影响。其次,考察德国、美国、日本等职业教育发达国家校企合作立法,总结经验与启示。最后,在分析国内法律法规并借鉴国外先进经验的基础上,提出通过修订《职业教育法》,增加有关校企合作的内容,适时出台全国性校企合作专门法规,加快地方校企合作立法等途径,有步骤地完善职业教育校企合作法律法规体系。

Abstract
Vocational education is an important part of the national education system. As a talenttraining mode of vocational education, school-enterprise cooperation plays an irreplaceablerole on the training of high-quality talent. The party and the government have developed aseries of policies to encourage school-enterprise cooperation, and vocational schools havealso developed cooperation with enterprises. However, there are many commonly existingissue needs to be addressed urgently in school-enterprise cooperation of vocational educationin our country, mainly including, the single mode of cooperation,the low level ofcooperation, the shortage of enthusiasm of enterprises, undefined government responsibilities,confusion between rights and obligation of related subjects, the infringement of right ofinterns and so on. These problems restrict the development of school-enterprise cooperation,and limit the ability of the vocational education training personnel.
This paper adopts field research, document analysis, comparative analysis and otherresearch methods, intends to resolve the existing issues in school-enterprise cooperation fromthe perspective of legal system. Firstly, through visiting related subjects of school-enterprisewe can clarify the main issues and difficulties faced by school-enterprise cooperation, byusing investigation. On the basis of this, through organizing and analyzing Chineseschool-enterprise cooperation laws and regulations between central and local, we are aimed toexplore the effect of law system lacking to school-enterprise cooperation. Secondly,investigate school-enterprise cooperation laws and regulations of Germany, the United States,Japan and other countries to summarize experience. Finally, on the basis of studying domesticlaws and regulations and referencing useful foreign experience, we put forward legislativeproposals to perfect the legal system,mainly including the revision of “Vocational EducationLaw” and the formulation of national and local school-enterprise cooperation law.
