摘要：我国现行的劳动与社会保障法律法规对实习大学生的人身伤害问题没有做出明确的规定，能否将其认定为劳动法意义上的“工伤”存在较大分歧。在司法实务中，实习大学生的人身伤害事故一般是诉诸民事法律进行解决，但因救济难度大和保障能力有限等问题而无法得到有效救助。基于此，系统考量了实习大学生人身伤害的法律保障问题，尝试从法理逻辑上为实习大学生人身伤害纳入工伤范围和实现最大法律保障提供一定的理论支撑。从剖析两则实习大学生遭遇人身伤害的典型案例入手，引出研究劳动与社会保障法调整实习大学生人身伤害问题的重要意义；阐述了大学生实习的法律性质，梳理了对实习大学生法律身份、与实习单位法律关系的争议论断；分析了实习大学生人身伤害的现行民事法律保障途径以及存在的举证困难、前提不足、能力有限、成过髙等问题，进而对实习大学生人身伤害事故能否认定为“工伤”进行辨析；并借鉴境外发达国家和地区关于实习大学生人身伤害法律保障的先进经验，创新性提出“倾斜保护、利益均衡、最大保障”原则，分类界定实习大学生适用劳动法情形，将实习大学生人身伤害纳入工伤范围，建立强制性工伤制度，拓宽法律救济渠道，通过构建以劳动与社会保障法为主导，协同民事等法律为补充的实习大学生人身伤害综合法律保障体系，切实保障实习大学生的合法人身权益。

Abstract: Due to no clear rules for the personal injury problems ofcollege students during the internship in our current labor and socialsecurity laws, opinions are divided on this point whether this problem canbe appropriate for industrial injury. In judicial practice, the personalinjury accidents of the internship college students usually resort to civillaw, but can't get effective relief on account of great relief difficulties andlimited security abilities. Based on this, this article systematicallyconcerns the legal security for personal injury of the internship collegestudents, attempts to provide certain theoretical support that the injurycan be included into the scope of industrial injury and attains the biggestlegal security. This article dissects two typical cases to illuminate thesignificance of this study; expounds the legal character of internship forcollege students, combs the legal identity of this group, controversialassertion of legal relationship with internship unit; analyzes the presentcivil law security pathways and the existing difficulties of proof,insufficient premise, limited ability and the high cost, and discriminatethe feasibility that the internship college students' personal injuryaccidents can be identified as industrial injury; draws lessons fromforeign developed countries and regions advanced experience, initiativelyputs forward the principle of tilt protection, balanced interests andmaximum guarantee, suggests the classification definition of theapplicable labor law for the internship college students, and the injuryshould be brought into the scope of industrial injury. This article suggestsbuild system of mandatory industrial injury, widen law relief channels,and establish comprehensive law system for the personal injury ofinternship college students which is oriented by labor and social securitylaw and supplemented with civil law, etc.
