近年来，我国“地沟油”案件频发，食用油安全形势异常严峻。随着小商小贩到中小企业、大型企业甚至国内知名企业“地沟油”违法事件的连续曝光，我国食用油安全问题已经成为广大人民群众日益关切的热点问题。如何监管好“地沟油”,防止其流向餐桌，保障食用油质量安全和城乡居民的生命健康权免受不法侵害，是一个关系国计民生且亟待解决的重要问题。
本论文从法律的角度，力图通过对我国“地沟油”监管法律制度的研究，建立健全我国“地沟油”监管法律制度体系。
本文分为四个部分：
第一部分，通过对近期我国频发的食用油事件的回顾，概括了本文的研究思路和结构安排，并指出了本文的研究意义。
第二部分，然后，在分析“地沟油”监管法律制度研究的必要性的基础上，通过对我国“地沟油”监管法律制度现状的分析、研究，剖析我国“地沟油”监管法律制度存在问题及其成因。
第三部分，介绍、分析了部分发达国家监管“地沟油”法律制度，从中总结出我国建立、健全“地沟油”监管法律制度值得借鉴的成果经验。
第四部分，在借鉴发达国家先进经验和技术基础上，探讨突破当前“地沟油”监管“瓶颈”的方法，努力构建保障食用油安全的法律监管模式，建立健全我国“地沟油”监管法律制度体系。

ABSTRACT
In recent years, cases of illegal cooking oil have occurred frequently, andedible oil safety situation has become extremely severe. With successiveexposure of illegal cooking oil cases of vendors, small, medium-sized, large andeven some domestic well-known enterprises, the safety issue of edible oil hasbecome a growing concern of the broad masses of people in China. How to dealwith illegal cooking oil and prevent it from flowing to dining-table so as toguarantee safety of edible oil and the rights for life and safety of urban and ruralresidents has become a burning problem.
From the legal perspective, this thesis bases its research on the study oflegal control system of illegal cooking oil and discusses how to construct andperfect the legal control system of illegal cooking oil in China.
The thesis consists of the four following parts.
The first part reviews the safety issues concerning edible oil in recent years,talks about the research route and structure of the thesis, and then highlights thesignificance of this research.
The second part starts from analysis of necessity of research on legalcontrol system of illegal cooking oil and then through analysis and research ofthe present situation of legal control system of illegal cooking oil, this part dealswith the problems and causes of the existing legal control system of illegalcooking oil in China.
The third part, introduction, analyzes some developed countries legalcontrol system of illegal cooking oil, summed up the establishment, perfect legalcontrol system of illegal cooking oil of our country is worth using for referencethe results from the experience.
The fourth part draws on the successful experience and advancedtechnology of developed countries, discusses how to break through thebottleneck of the current approach of illegal cooking oil control, how toconstruct legal supervision model to guarantee edible oil safety, and then how toconstruct and perfect the legal control system of illegal cooking oil in China.
