摘要
进入 20 世纪末，流浪儿童成为了全球性的问题而我国正处于社会转型时期，而流浪儿童也逐渐成为了社会近年来的热点问题，受到社会广泛关注。如何救助流浪儿童，从制度层面和具体救助措施的实施都存在一些问题和困难，新疆乌鲁木齐作为多民族聚居的地方因为经济落后、生活环境差、地域特殊等，流浪儿童的人数较多已成为社会的热点问题，同时由于救助制度存在有很多不健全的地方，需要我们进一步的完善和建立符合乌鲁木齐地域情况的流浪儿童救助的制度体系。本文作者论述了新疆流浪儿童救助制度中存在问题，同时还介绍了相关地区流浪儿童的救助制度，重点阐明了乌鲁木齐应当结合民族地区特点建立符合乌鲁木齐地区特点的流浪儿童的救助制度。
本文主要从四个方面对新疆流浪儿童救助的法律问题进行分析和研究。
第一部分是流浪儿童救助的概述。主要阐述了有关流浪儿童救助的基础理论。界定了流浪儿童的概念、分析了流浪儿童的特点以及产生的原因，论述了救助流浪儿童的原则和法学理论依据，从理论层面对上述问题作出了分析和探讨。
第二部分主要是针对流浪儿童救助法律制度的分析。较深入分析了我国现有的救助制度中存在的缺陷和不足，找出问题的原因所在。同时通过比较分析的方法对发达国家和发展中国家的流浪儿童救助法律制度进行比较与分析，旨在学习和借鉴国外成熟的经验。
第三部分重点以乌鲁木齐市流浪儿童为例，分析了乌鲁木齐市流浪儿童救助的现状。针对乌鲁木齐市的流浪儿童生存和受救助的情况以及在救助过程中存在的问题做出了较为细致地分析。
第四部分是依据第三章乌鲁木齐市流浪儿童的存在的问题，提出了救助乌鲁木齐市流浪儿童的具体对策，特别是阐述了救助制度应当结合本地区现有的资源和优势借鉴内地一些省市的流浪儿童救助经验建立富有本地区特色的流浪儿童救助机制。

Abstract
In the 20th century, Street Children has become a global problem and in theperiod of social transformation in our country, and street children also graduallybecame a hot issue of the society in recent years, wide attention from society. How tohelp homeless children, from the aspect of system and the implementation of therescue measures there are some problems and difficulties, in Urumqi, Xinjiang as amulti-ethnic populated places because of backward economy, poor living environment,regional special, etc., the number of street children more has become a hot socialproblem, at the same time due to incomplete assistance system there are a lot of places,we need to further improve and establish in Urumqi region situation of street childrenrescue system. In this paper, the author discusses the problem of street children rescuesystem in Xinjiang, and also introduces the related areas of street children rescuesystem, mainly illuminates the Urumqi should be combined with characteristics ofethnic areas in Urumqi region characteristics of street children rescue system.
This article mainly from four aspects of Xinjiang Street Children rescue analysisand research on the legal issues.
The first part is an overview of street children rescue. Mainly expounds the basictheory about street children rescue. Define the concept of street children, analyzes thefeatures of street children and their causes, discusses the principle of rescue streetchildren and legal theory basis, from the theoretical level to made analysis anddiscussion on these problems.
The second part mainly for Street Children rescue the analysis of the legalsystem. Deeply analyzes the existing defects and insufficiency in assistance system,find out the cause of the problem. At the same time, through the method ofcomparative analysis of developed countries and developing countries by comparingand analyzing the legal system of street children rescue, aims to study and drawlessons from foreign mature experience.
The third part mainly in Urumqi city street children, for example, the paperanalyzes the current situation of Urumqi city street children rescue. Aimed at Urumqistray child survival and rescue the situation and the problems in the process of therescue has made a more detailed analysis.
The fourth part is based on the problems existing in the third chapter of Urumqicity street children, puts forward the concrete countermeasures of Urumqi city streetchildren, especially expounds the assistance system should be combined with theregion of the existing resources and advantages refer to some provinces and cities ofthe mainland street children rescue experience to establish the region features of streetchildren rescue mechanism.
