中国对食品安全的监督管理探究

  从 2008 年三聚氰胺事件引起全民对食品安全的关注以来,食品安全就成为刺激民众神经的敏感词汇。2009 年的面粉增白剂、蒙牛特仑苏 OMP 奶等,2010年的“龙虾门”事件、地沟油和海南毒豇豆等,2011 年的双汇瘦肉精事件、染色馒头事件和毒豆芽事件等,2012 年的铬超标“毒胶囊”事件、伊利部分批次奶粉汞超标事件和酒鬼酒塑化剂超标事件等,2013 年的广药维 C 银翘片被曝含有剧毒砷汞残留、农夫山泉质量门和老鼠肉冒充羊肉事件等,一桩桩食品安全事件使得消费者谈食色变。
  
  食品安全关系到每一个人的生活质量,关系到经济的健康发展,关系到社会的和谐构建。然而目前我国食品安全问题却比较严重,究其原因,固然有食品生产者的道德丧失,违法成本较低等因素,但是,笔者认为,更重要的原因还是在于食品生产流通销售环节政府监管存在漏洞,即食品安全监管体系的尚不健全。
  
  鉴于一些发达国家食品安全监管工作起步早,监管制度成熟且监管体系已趋于完善,本文将对美、德、日等为代表的发达国家食品安全监管具体做法进行比较系统全面的归纳总结,以从中窥探其可供我国借鉴的成功经验,最后本文认为需要从监管主体、监管客体、监管手段、监管目标以及反馈机制建设等诸多方面来完善我国的食品安全监管体系以应对我国的食品安全问题。
  
  由此不难梳理出本文的构思脉络,即首先从食品安全监管的相关基础理论进行主题切入,为问题的发现、原因的解析以及对策的提出奠定理论基础;接着分析我国食品安全监管体系完善中尚存在的难题;最后借鉴发达国家食品安全监管工作的成功经验,结合我国食品安全监管的实际,提出适合我国食品安全监管体系完善的策略。

  Abstract
  
  Since the year of 2008 when the Melamine incident aroused widespread attention,food safety has become sensitive words that keep stimulating people's nerves. Suchunexpected incidents of food safety happened in China strike great terror in the hearts ofpublic figures, such as flour brightener scandal in 2009; OMP, an addictive inMengniu's Telunsu line; the crayfish event, “gutter oil” and poisoned cowpea in HainanProvince in 2010; the Shuanghui “lean powder” event, dyed steamed buns event andpoisoned bean sprouts event, etc, in 2011; “toxic capsule” event, the “elevated mercurylevels” event of certain batches of milk powder produced by Yili Group Ltd andindustrial plasticizer unfantastic of the Jiugui Liquor, etc, in 2012; and in 2013, VitaminC Yin Chiao Tablet made by Guangzhou Pharmaceutical Holding Ltd, in which highlytoxic substances, Arsenic and mercury residues were found, the Quality-gate event ofNongfu Spring and rat meat dressed up as mutton scandal, etc.
  
  Food safety is concerned with everyone's life quality, with the healthydevelopment of the economy as well as with the construction of the social harmony.
  
  However, food safety in China is fairly severe to some extent. When tracking the reasonfor the phenomena, there is no denying the fact that the factors, such as the moraldisintegration and low cost of illegal activities should be to blame indeed. Nevertheless,in the author's opinion, what is even more important reason is that the regulatorylacunae in the selling process of the food production and supply chain section, i.e., theimperfectness in the supervisory system of the food safety.
  
  Considering that food safety regulation started early in some developed countriesso that the supervisory system is fairly sound and the supervision system has beentending to perfectibility, this article makes a conclusion and comments on some specificpractice existing in the supervisory system of food safety in the developed countries,taking the United States, Germany, Japan and some other developed countries asexample, thus to spy on the successful experience which can be adopted in China. In theend, the article concludes that the government, in order to deal with the problemsexisting in China's food safety, needs to perfect the supervisory system of food safety inthe following ways, i.e., the regulation subject, regulation object, means of regulation,regulatory goals, and the counter-construction of feedback mechanism etc.
  
  Therefore, the conception of this article is clear and simple: first, certain theoriesconcerning food safety regulation serve as the point cut which lays a theoreticalfoundation for the following analysis of the existing problems as well as thecorresponding countermeasures; and then the article talks about the existing problems inthe food safety regulatory system; finally, based on the successful experience in the foodsafety regulation in some developed countries and by combing the actual facts in China,the article concludes some countermeasures to perfect the food safety regulatory systemin China.
