摘 要
随着我国经济发展进入快车道，人们生活水平越来越高，居民的个性化出行也越来越突出，适应这一需求的出租汽车运输方式迎来了行业的大发展。据统计，至 2013 年底全国共有出租汽车 120 余万辆，年完成客运量 370 多亿人次，约占城市客运量的 30%.近些年，我国大中城市经常出现出租汽车驾驶员群体性事件，引起了社会各界的关注。
本文通过对出租汽车行政许可制度的法理考察，结合国内出租汽车许可制度的现状，对我国出租汽车行政许可制度存在的主要问题及原因进行分析，剖析了出租汽车行业在当今社会经济深刻发展变化的背景下，完善和发展出租汽车行政许可制度的必要性。同时，借鉴国内出租汽车行政许可制度改革发展的经验，提出了我国出租汽车行政许可制度构建的总体方案构想。本文以文献研究和实证调研方式为主，研究的主要成果包括两个方面：第一，就是从出租汽车行政许可的角度分析出租汽车行业存在的问题、成因，及这些问题与许可制度设计的关系。二是提出出租汽车行政许可制度的完善建议，指出在完善出租汽车行政许可体制上，应实现政府权力的有效配置和职能转变；通过立法建立统一出租汽车许可制度，明确许可项目、条件和程序；构建出租汽车行政许可的双轨制；建立附条件的出租汽车行政许可制度，完善出租汽车许可配套制度，以期实现对出租汽车市场的有效调控，达到完善出租汽车行政许可制度的目标。

Abstract
As Chinese economic development has entered the fast lane, people's living standard isgetting higher and higher, the residents' personalized travel increasingly arises, taxi transportwhich meets this demand ushered in the development of the industry. According to statistics,by the end of 2013 there were more than 120 taxis in the whole country, passenger traffic wascompleted more than 37 billion people in the year, accounting for about 30% of passengertraffic in cities. In recent years, group events of taxi drivers often happened in large andmedium-sized cities of China, which attracted the attention of the community. This paperanalyzed the major problems of the administrative permission system of taxi and their causes,which by means of the legal principle research about the administrative permission system oftaxi, combined with the status of domestic taxi licensing system. It dissected the necessity ofimprovement and development of the administrative permission system of taxi, against abackground of profound changes in today's social and economic development. At the sametime, it learnt from the experience of the reform and development which belong to theadministrative license system of domestic taxi, put forward the idea of the overall program ofthe establishment of the taxi administrative license system in our country. This paperprincipally adopted the way of document research and investigation, the main results of thestudy includes two aspects: first, from the administrative license system of taxi, analyses theproblems which exist in the taxi industry and their causes, and the relationship between theseissues and the design of licensing system. Second, put forward some suggestions to improvetaxi administrative licensing system, pointing out that if we want to perfect taxi administrativelicensing system, we should achieve effective allocation of government power and thetransformation of government functions; to establish a unified taxi licensing system dependon legislation, to express the permission of items, conditions and procedures; to build thedouble track system of taxi administrative license; to establish the administrative licensesystem of taxi which attached to additional conditions, to improve the supporting system oftaxi licenses, in order to achieve effective adjustment to the taxi market, and to realize thegoal of perfect administrative license system of taxi.
