摘要
随着社会的发展，动物权利的保护越来越受到人们的普遍关注，特别是社会上普遍存在的虐待动物、伤害动物的行为，往往能够引发人们对动物保护的反思及对我国动物保护立法现状的思考。然而，不难发现的是，我国目前现存的关于动物保护的立法在社会实践中常常出现法条空白，无法可依的尴尬现象，或者是法条规定太过笼统、模糊，人们无法准确运用。然而，纵观国外相关动物保护的立法实践，不难发现有很多地方值得我国借鉴。因此，我们要以国外的立法经验来完善我国的动物保护立法与司法实践，达到人与动物和谐共处的美好局面。
笔者通过以下五个章节进行论述：在第一章绪言中介绍了研究动物保护的意义及方法，国内外研究的现状，最后交代了自己写这篇文章的主要创新点；第二章通过对国内外动物保护的概述，阐述了有关动物保护的几个基本概念并分析了国内外动物保护的基础理论，最后指出了动物保护立法的现实意义；第三章着重介绍国外动物保护的立法现状及对不同国家地区动物保护立法实践进行评析，进而试图找到符合我国国情的动物保护立法途径；第四章笔者通过对我国动物保护现状的反思，深刻剖析造成我国动物保护缺陷及不足的原因，并探索解决这一问题的法律建议和策略；第五章就是在问题存在的基础上对症下药，寻找并提出完善我国动物保护立法的建议。
综上，笔者不仅是全面的分析总结介绍了我国动物保护的现状和立法完善建议，而且还在一定程度传播了保护动物的思想意识，并希望自己能为人类与动物的和谐共处尽一份绵薄之力。

Abstract
With the development of the society,animal rights protection has become more andmore get the attention of people, especially the widespread the act of cruelty to animals,animals, often can cause the people to the protection of animals reflection and thinking aboutthe present situation of animal protection legislation in our country. However, it is notdifficult to find that existing in our country at present about animal protection legislationoften appears in the social practice law blank, could not be in accordance with the phenomenaof embarrassment, or is too general, fuzzy, people cannot use accurately. However,throughout the foreign related animal protection legislation practice, it is not difficult to findthat there are a lot of places worth our using for reference. Therefore, we should take foreignlegislation experience to perfect our countryfs animal protection legislation and judicialpractice, to achieve a good situation of people and animals live in harmony.
The author discussed through the following five chapters: in the first chapter in theexordium introduces the research significance and the method of animal protection,domesticand foreign research literature review, finally confessed himself writing the main innovationpoint of this article; The second chapter through the overview of animal protection at homeand abroad, expounds some basic concepts about animal protection and analyzes the basictheory of the protection of animals at home and abroad, finally points out the realisticmeaning of animal protection legislation; The third chapter introduces the foreign animalprotection legislation present situation and the legislative practices of different countries andregions to protect animals, animal protection way to then find accord with China's nationalconditions; The fourth chapter the author through the reflections on the current situation ofanimal protection in China,deeply analyze the cause of defect and lack of animal protectionin China,and explore legal advice and way to solve this problem; The fifth chapter is theproblem in exist on the basis of suit the remedy to the case, to find and put forwardSuggestions of perfecting our country's animal protection legislation.
