摘 要
20 世纪 90 年代开始，南极商业旅游迅速发展。南极旅游是一种完全异质于其他模式的旅游：不由政府直接管理或主要资助、无接待国或旅游目的地国、无任何直接的旅游管理者和旅游服务设施、不存在刺激当地经济发展的问题等，且与南极权利主张、极地规则制定话语权、南极科考秩序等紧密相连，南极旅游的交通工具主要是通过游船进行，因而也带来了南极航行安全和环境安全问题，所以，研究南极旅游的海事法律规制问题显得尤为重要。
本文主要是通过对南极旅游国际海事法律规则和国别法律规则的分析，发现目前规制南极旅游的国际海事法律起不到有效监管的作用，通过剖析南极旅游国际海事法律规则的未来发展趋势，得出南极旅游的未来海事规则发展还需要以南极条约协商会议作为主导力量，以港口国监管、IAATO 等国际组织协作为辅助，将规制对象扩大到方便旗船现象、非缔约国经营人等，进而为丰富我国南极旅游、南极环境保护等法律规则研究提供借鉴，进一步提升我国在南极规则制定上的话语权。

ABSTRACT
Beginning in the 1990s, Antarctic tourism business has rapidly developed.
Antarctic tourism is a completely heterogeneous than other modes of travel: not bydirect government management or major funding, no host country or traveldestination, without any direct travel managers or travel service facilities, needn't tostimulate local economic development. Furthermore, Antarctic tourism is related toAntarctic claims, discourse power of Polar Code legislation and Antarctic expeditionorder. Antarctic tourism transport is mainly carried out by vessels, and thus broughtthe Antarctic ocean navigation safety and environmental safety issues, therefore it isimportant to discuss maritime legal regulation related to Antarctic tourism.
This article mainly analyzed the international maritime law and domesticmaritime law of four other countries to find that the current international regulationsof Antarctic tourism are ineffective. By analyzing the trend of international maritimelaw development related to Antarctic tourism regulation, this article showed that thefuture of maritime regulation about Antarctic tourism depends on the Antarctic TreatyConsultative Meeting as the dominant force, Port State Control （PSC）， IAATO andother international organizations to cooperate for the assistance, expanding theregulatory target to flag of convenience vessels phenomenon, non-party operators, etc.On this basis, this article draws out some suggestions about enriching our legalframework regulating Antarctic tourism and enhancing our discourse right on theAntarctic rulemaking.
