摘 要
目前我国的市场经济正在起步发展中，法律、法规及法制环境有待进一步健全和完善。合同履行过程中，合同各方为保护各自的利益，加上各方合同管理水平的差异，由此导致的合同纠纷及造成的损失屡见不鲜。特别是在工程建设领域，由于合同标的物的特殊性，合同主体、合同关系的复杂性，如果不重视合同关系的管理，就会导致合同界面混乱，合同各方的责、权、利不确，合同关系混乱不清，合同各方经常陷于扯皮和矛盾中，由此带来进度、质量成本管理的失控。
在工程项目中，存在着业主方、承包方、监理方、供货方等不同方面的合同管理，其中业主方的合同管理又是整个工程合同管理的核心，对整个项目的合同管理甚至整个项目的成败都起着至关重要的作用。业主如何通过加强合同管理，保证项目进度、质量、成本目标的实现，最大限度的保护业主的利益，制风险，实现项目和企业的战略目标，追求合同各方在经济合作中的共赢局面，是建筑工程领域中亟待解决的问题。
本文从当前工程项目业主方的合同管理现状分析出发，首先论述了加强工程项目合同管理的必要性和重要性，然后针对工程项目存在的复杂合同关系，提出构建全面合同管理体系，对于 A 住宅项目实施全项目、全过程 、全员合同管理的理念和方法，分析了业主方全面合同管理体系的保证体系，并对作为全面合同管理主要方面的项目合同策划管理、招标阶段的合同管理、合同控制管理及合同变更管理等相关问题行分析和阐述。
通过论证，本文得出业主方的全面合同管理不仅仅是对具体合同的管理，而且是从项目整体利益出发，组织、协调各管理部门及合同关系方，以合同为纽带进行的全项目的管理；不仅仅是某个阶段的合同管理，而且而是整个项目全过程、全方位、多层次的合同管理；不仅是合同管理部门的合同管理，而是整个项目全员的合同管理。本文通过对业主方全面合同管理体系的研究，研究业主方合同管理主要方面，探讨建立适合工程项目业主方项目合同管理的有效应用模式，以期待对其他业主工程项目的合同管理实践有所借鉴。

ABSTRACT
At present, the market economy is developing at domestic, while the laws,therules and legal systems still need to improve and perfect. Therefore, it is found a lotof contract disputes, which also could cause economic lost exist popularduringcontract performance, due to different factors, such as protection ones ownbenefits,different contract management levels of each part in contract. In the field ofproject constructions, this phenomenon stands out, because of the specialty ofcontract objects,the complexity of main body of contract. As a investor of engineeringproject, the owner has to strengthen the project management based on the contractmanagement, guarantee the realization of controlling objectives including the projectcost,schedule,and quality.
During the process of the owner's engineering project, the contract managementinvolves different targets such as the owner, the project inspector, the contractor,thesupplier and so on. Among these, the owner's contract management ,which in a strictsense the project inspector's contract management belongs to, is the core of the wholeengineering contract management and plays an important role in the whole projectcontract management and even success or fail of the whole project. , in order to bringcontract planning into play effectively, protect owner 's benefits to a maximum,control the risk successfully, carry out objectives of projects and enterprises wholly,and pursue the multi-benefits of contract each body, ,the owner must investigate howto plan contact tightly and control the procedure strictly to realize the above purposes.And it is also a urgent issue in the engineering field.
In this dissertation , the author will first give a general account of the contractmanagement in different steps during the process of owner's engineeringproject ,which discusses the action of the engineering contract management intheproject management and the general measure to strengthen the contractmanagement .Then by the detailed discuss of the contents of contract management（including the general contract plan, the bidding management ,the control of thecontract execution and the change management and so on）and the case study of' Abuilding Project',some important conclusion will be made :the owner's contractmanagement is not only the management of a specific contract ,but also that of theowner's overall engineering project contract ;it is not only the contract managementof some step ,but that of the whole process ,the whole position and the richarrangement of ideas ;it is not only the contract management of contract managementdepartment ,but the contract management of all the employees .
By discussing the owner's contract management during the process of theowner's overall engineering project, the author hopes that the dissertation can provideuseful reference for the contract management work in the owner'sengineeringproject,Especially In the Medium and small engineering projects. improve theconstruction project contract management put forward some suggestions.
