摘要
近年来，恶意透支型信用卡诈骗罪呈现高发、高发、高增长趋势。如何对该罪进行认定尚存在为数不少的争议。通过较为详尽的分析该罪的构成要件，梳理其中的争议，有助于将恶意透支型信用卡诈骗罪的整体形象呈现在我们面前，也更有助于立法和司法的完善。
本文共分为四大部分。文章第一部分通过国内外立法比较，阐述信用卡恶意透支的概念及其分类；文章第二部分则从恶意透支型信用卡诈骗罪的主体、主观方面、客体、客观方面来分析实务中遇到的具体问题和理论上的争议；文章第三部分主要从刑事司法角度，思考如何解决信用卡诈骗犯罪审理和规制的难题；文章第四部分从立法和其他社会层面入手，提出立法建议并希望通过自己的论述实现对立法司法有所助力。

Abstract
In recent years, the crime of malicious overdraft of credit cardfraudhas been on a high-risk, high growth trend. There are many argumentson how to identify the crime. Through analyzing the crime constitution,sorting out several issues and arguments, the paper focus on presentingthe overall image of the crime of malicious overdraft of credit card fraudand puts forward suggestions on legislation and judicature perfection.
This paper is divided into four parts.
The first part of this article pays attentions on the concept ofmalicious overdraft of credit card and its classification.
Secondly,the subjective and objective aspects of the crime areanalyzed and summarized, the concrete problems which have beenencountered in the judicial practices and several arguments which havebeen argued in theory fieldare proposed.
Thirdly, judicial principles on how to hear cases relating maliciousoverdraft of credit card are raised.
Finally, the author hopes to establish a perfect and effectiverestricted system on the legislation, administration and other socialfields, so they can solve the problems of credit card fraud crime.
