摘 要
最近几年,中学生违法犯罪率居高不下,给社会发展与稳定造成了很大影响,也给人民群众的人身和财产造成了巨大的损害,如何解决中学生违法犯罪问题,是摆在我国法治社会建设中的一个重要问题。中学生违法犯罪行为增多,这与中学生法制教育不到位有密切的关系。当前,各个中学、社会、家长等虽然已经在一定层面上认识了中学生法制教育的重要性,但是在思想上却没有真正地重视起中学生法制教育,导致中学生法制教育中还存在着不少问题。本文详细分析了目前中学生法制教育中存在的问题,认为在目前的中学生法制教育当中,学校教育没有发挥出应有的作用,家庭教育开展不到位,社会教育作用不突出,学校、家庭和社会之间,在中学生法制教育上没有形成合力,社会上的一些不良思想和观念,对中学生法制教育的效果起到了弱化的作用。要想解决这些问题,笔者认为在中学生法制教育中应该从学生自身、家庭、学校和社会事务的角度,构建起完善的法制教育体系。从学生自身的角度来讲,应该加强自我约束、自我管理能力的培养,学会自我管理和自我约束。从家庭的角度来讲,要不断提升家长的素质与能力,丰富家长的法律知识,掌握一定的法制教育方式方法,同时要为中学生的健康成长创造一个良好的家庭环境,科学地运用说服教育、沟通教育等家庭教育方法。当然,必须发挥学校教育的主体性作用,在这一方面应该编制新的具有可读性、趣味性的教材,在此基础上改进和完善教学方法,建立一支高水平的专业教师队伍等;在社会教育方面,既要发挥媒体宣传在法制教育上的作用,还要充分发挥政府及司法部门在社会教育中的作用,将法制教育作为相关司法部门的一项基本职能。在此基础上,将学校、家庭和社会三者有效结合起来,不断提高中学生法制教育水平,发挥中学生法制教育在预防和控制中学生犯罪中的作用。通过上述研究,希望能够对当前的中学生法制教育相关单位、部门提供一些帮助和启示,使其从思想上重视起中学生法制教育,在此基础上不断提高中学生法制教育的实效性,更好地解决中学生违法犯罪问题。

ABSTRACT
In recent years, the phenomenon of the high middle school students' delinquency,found no clear data has a great influence to the social development and stability, but also topeople's personal and property caused great damage to the middle school students, how tosolve the crime problem, is an important issue in the construction of rule of law inChina .The increase of middle school students' delinquency behavior, which has closerelationship with the legal education of middle school students is not in place. At present,each high school, society, parents etc. although already in a certain level understanding ofthe importance of legal education of middle school students, but not really pay attention tothe legal education of middle school students in thought, which leads to many problemsstill exist in the legal education of middle school students. In this paper, a detailed analysisof the existing problems in the legal education of middle school students, middle schoolstudents think in legal education at present, school education can not play its due role,family education is not in place, the social education function is not outstanding, betweenschools, families and society, did not form a joint force in legal education of middle schoolstudents, some bad thoughts and ideas the society, the legal education in middle schoolstudents effect plays a role of weakening. To solve these problems, the author thinks thatshould from the students themselves, family, school and social affairs in the legal educationof middle school students on the point of view, building up a perfect system of legaleducation. Students from the perspective of their own, should strengthen self-discipline,cultivating the self management ability, learn self-management and self constraint. Fromthe family perspective to continuously improve the quality and ability of parents, parents ofthe rich legal knowledge, master the method of certain legal education, and to create agood family environment for the healthy growth of the students, the scientific use ofpersuasion and education, communication education family education methods. Of course,in the school education must play the role of subjectivity education, in this respect shouldprepare the new readable, interesting teaching materials, on the basis of improving andperfecting the teaching methods, the establishment of a high level of professional teachers;in the social education, should not only play the role of media in legal education on the, butalso give full play to the role of the government and the judiciary in social education, thelegal education as a basic functions related to the Department of justice. On the basis ofthis, the school, the family and the society effectively combine the three, and constantlyimprove the level of middle school students in middle school students of legal education,legal education play in the prevention and control of juvenile crime function. Through thisresearch, hope to provide some help and Enlightenment to the current middle schoolstudents legal education related units, departments, make its have the legal education ofmiddle school students pay attention to from the thought, and continuously improve theeffectiveness of legal education of middle school students on the basis of this, neveragainst crime of middle school students problem solution better.
