摘 要
安全生产应急预案作为应急预案体系中的重要环节，其实施的效果直接关系到人们群众的生命财产安全，因而倍受关注。与发达国家相比，我国仍然属于安全生产事故的“重灾区”.虽然我国安全生产事故应急预案已初具规模，但是各层级安全生产应急预案仍面临着法律性质不明确、适用领域有待拓展、内容空洞缺乏可操作性、各部门间缺乏有效的沟通协调、制定执行等程序有待完善、重制定轻修订、法律责任不明晰等一系列问题，对于安全生产应急预案的实际效用造成了较大影响。
制定合法、科学、高效的安全生产应急预案已经成为全球防范安全生产事故重点关注的领域。欧美等国在安全生产事故应急预案方面的法律制度构建较早并取得了一定的实施效果。本文通过借鉴欧美等国的先进经验 ,针对明确安全生产应急预案的法律地位、拓宽应急预案的适用范围、改进应急预案的内容、完善应急预案制定执行的程序、重视应急预案的修订、严格应急预案的违法责任等方面提出建议与意见，希望为进一步完善我国安全生产应急预案献计献策。

Abstract
Work safety emergency plan, as an important link of emergency system, theimplementation of the plan directly related to people's property and safety, thereforeneed to be more attention. Compared with developed countries, China still belongs tothe worst area. Work safety emergency plan has certain scale, but the level of worksafety emergency plan is not clear, scope of the application need to be broad,emergency plan is vacuous and lack of practicality, government departments lack ofcooperation, formulation and execution dose not perfect, review system pay notenough attention, legal responsibility is not clear and so on. To improve the worksafety emergency plan content, enhance its actual effect has caused great influence.
To formulate legal, scientific and efficient work safety emergency plan hasbecome the world focus on the areas of work safety accident, how to prevent,understanding and correct dealing with the work safety accident has become theworld's countries face common topic. Europe and the United States and othercountries of work safety accident emergency plan early on legal system constructionand good effect, this paper want to learn a lesson from the Europe and the UnitedStates, ascertain its legal status, board the scope of the application, modified content,modified the procedure, pay more attention to revision, ascertain the illegal liability.Hope to further perfect our emergency of the work safety.
