保证金作为民商事活动中的维护交易安全、保障债权入合法利益的重要环节，适用广泛，涉及各类领域、形式各样，但长期以来缺乏明文规定，对其性质认定不清，对进入纠纷的保证金性质及效力范围始终未能形成统一的定性，阻碍了保证金本应具备的促进商品流通、维护交易安全的作用，研究保证金的性质，有助于保障市场诚信运作的积极功能，同时保障主债权实现、减少债权损失的消极功能，也有利于我国保证金制度的健康发展及有效运行。本文认为保证金是一种有别于担保法五种常规担保的独立担保形式。

Abstract
Margin as civil and commercial activities in the maintenance oftransaction security, ensuring creditor's rights into the legitimate interests ofthe important link, widely applicable, involving various fields, a variety offorms, but long-term since lack of express provisions on the determination ofthe nature, is not clear, to enter the nature and effect of deposit disputes thescope has failed to form a unified qualitative, hindered the guarantee the goldshould have promote the circulation of commodities, the maintenance oftransaction security role, properties of margin, contribute to the increase incredit and other positive features, as well as the main compensation claims toachieve, reducing debt losses of negative function, but also beneficial to thehealthy development of margin system and its effective operation.
The author thinks that the margin is a different guarantee from 5conventional guarantee independent guarantee form.
