在我国，随着经济发展的越来越迅速，工业化程度越来越高，职业病危害也曰趋严重起来。为了能让我国目前职业病防治的发展有更多进步，笔者将试着从四个部分来探讨我国职业病防治的法律规制问题，希望能有所帮助。
第一部分对职业病基本知识进行介绍；第二部分阐述并分析了我国现有职业病防治的法律规制缺陷，罗列了在职业病诊断过程中对诊断异议救济手段的不足、法律责任分担有偏差、缺乏足够的救助赔偿机制、工会组织未充分发挥作用以及现有规定与工伤保险制度衔接等6个问题；第三部分介绍了英美法系和大陆法系国家的职业病防治规定，通过比较与分析，列明了对我国现有制度的借鉴意义；第四部分着重于对如何完善我国职业病防治法律制度的思考，分别从立法和执法的角度表明自己的一些观点。立法上，我们可以尝试从立法思想、完善职业病双重救济权制度、增加职业病诊断异议的救济手段、完善职业病患者诊断申请权制度、完善职业病患者知情同意权制度、强化监管制度这六个方面来规范、修整我国整个的职业病防治的法律规制。在执法上，从对职业病现状的清楚认识，时刻保持警惕之心、到加强职业病防治理念灌输、让职业病诊断更专业与方便、再到尝试复合救济模式、坚持对用工单位的管理、以及最后对患者及其家庭如何救济帮助提出建议。通过以上介绍，希望能由此更好地对我国职业病防治的法律规制起到促进和完善作用，能更好地保护劳动者职业健康权益，从而真正实现和谐社会。

Abstract
In China,with the rapid development of our social economy, as well advancedmodern industry,the harm of occupational disease is more and more serious. In order toimprove our current occupational disease's legal regulations, through four parts'
introduction I will try to analyze these problems from daily law-enforcement; hope canbring some help to all.
The first part is the basic knowledge introduction to occupational disease; the secondpart is introduce and analyze the defects during the prevention activity of occupationaldisease, list 6 problems: the relief ways to diagnosis objection、unfair on sharing the legalresponsibility、short of assistance and compensation policy、the detailed responsibility ofunion organization、how to connect between occupational disease policy and the industrialinjury insurance system、control system; In the third part, I recommend and compare thedifferent occupational disease's legal regulations from the American legal countries and theCivil Law countries, summarize their experience and effect to China; the last part, I thinkhow to improve occupational disease's legal regulations. From the legislation side, we cantry to perfect it through setup advanced legislative thinking、improve the double assistancepolicy、add ways to diagnosis objection、make an occupational disease's diagnosisapplication right、and the labor worker has the right to know etc.; From the law -enforcement side,watch out for the status of occupational disease、enforce preventionconcept、insist on strictly management to employers etcThrough above introduction, I hope it can help and improve our occupationaldisease's prevention work, protect labor workers' health right, finally we can come true theharmonious society.
