摘 要
肖像权是一种重要的人格权。随着社会主义市场经济的发展、人们价值观念的变化，尤其是互联网络时代的来临，个人肖像被侵害的案件越来越多。司法实践中，肖像权侵害的案型多种多样，凸显的问题也不相同。肖像合理使用作为一种事实行为存在于肖像权保护体系内，不仅有关公民个人利益，而且有时还关系到国家和社会的公共利益。我国法律对肖像的合理使用没有作出规定，是我国肖像权制度的一大缺陷。完善肖像合理使用理论对于界定肖像侵权意义重大，本文通过立法和实践层面的考察， 论证了肖像合理使用制度的存在价值， 并对如何解决实践中涉及肖像合理使用的不同案件类型提出了自己的建议。
本文首先阐述了“肖像合理使用制度”,虽然我国法律并未规定，但国外法律和司法实践早已将肖像合理使用纳入法律体系内，我国许多学者也对肖像合理使用进行了很多学术探讨。接着，本文分四部分介绍了司法实践中容易涉及到肖像合理使用的案件类型，有新闻报道中肖像的合理使用、集体肖像的合理使用、死者肖像的合理使用及未成年肖像的合理使用，通过分析这些案件类型，总结出怎样认定某一使用肖像的行为是否属于合理使用，即使属于合理使用，法官在裁判此种案件时，是否也应顾及肖像权人的利益，怎样平衡肖像使用人和肖像权人的利益也是本文的研究重点。最后，通过上述分析，并比照《着作权法》中的“合理使用”制度，本文得出结论，即在我国确立肖像合理使用制度的必要性，并通过设立原则及列举的方式对我国设立肖像合理使用制度提出自己的建议。

Abstract
Portrait is an important personality rights. As the socialist market economy, changes inpeople's values, particularly the advent of the Internet age, personal portraits are more andmore cases of infringement. Judicial practice, the portrait rights infringement case type varied,highlighting the problem is not the same. Portrait of fair use as a fact that the behavior ofimage rights protection exists in the system, not only about the individual interests of citizens,and sometimes also related to the common interests of the state and society. Portrait of ourlaw does not provide for fair use is a major flaw of the portrait right system. Perfect portraittheory for the rational use of the definition of infringement significant portrait, the paperthrough legislation and practical level study demonstrates the existence portrait reasonablevalue of the use of the system, and how to solve different types of cases involving the practiceof fair use portrait put forward their own proposals .
This paper describes the “portrait fair use system”, although our law does not require, butforeign law and judicial practice has long included the portrait of fair use within the legalsystem, many Chinese scholars have also done a lot portrait rational use of academic research.
Then, the paper is divided into four sections describe the judicial practice related to the typesof cases easily portrait of fair use, there is a reasonable use of the rational use of news reportsportrait, rational use of collective portrait, portraits of the deceased and other conditions, byanalyzing these types of cases summarizes the use of a portrait of how determined whetherthe conduct fair use, fair use, even if the judge in such cases when the referee, whether itshould take into account the interests of the owner of the portrait, portrait of how to balancethe interests of people's right to use and portrait is the focus of this study. Finally, through theanalysis above, and, mutatis mutandis, “Copyright Law” in the “fair use” system, the paperconcluded that the need for rational use of portrait system established in our country, andthrough the establishment of principles and methods listed on the Establishment of areasonable portrait Use the system put forward their own proposals.
