摘 要
生育与人类的发展是息息相关的。对于世界各国来讲，人口已经成为决定其社会发展的关键因素之一。和其它绝大部分国家相比，我国人口数量庞大且人口增长过快，这就决定了我国不得不进行计划生育。然而，2012 年发生在陕西安康的强制引产事件，在社会上掀起了激烈的讨论。该事件叙述的是陕西安康的一名孕妇被当地计划生育部门的工作人员带进医院强制进行人流手术的事实。正是受到了来自上述事件的刺激，笔者决定借助本文对我国生育权进行了分析与研究。首先，本文对发生在陕西安康的强制引产案进行了回顾，并以此作为本文的写作背景来揭示我国生育权存在的现实问题，呼吁建立起宪法对生育权的保障。其次，本文通过对生育权的概念以及内涵的论述，来强调生育权是公民的基本人权。再次，本文展开了对生育权自原始社会以来的演变进行了深入的研究，揭示了生育权所具有的历史必然性。然后，本文对我国目前生育权保障所存在的种种问题进行了说明。最后，笔者对公民生育权宪法保障的必要性和如何构建我国生育权的宪法保障机制发表了自己的看法。
生育权是人权范畴内的一种权利。政府部门在要求公民履行计划生育义务的同时，也不能忽略对公民生育权的保护，国家必须采取必要的法律措施保证公民生育权不受非法侵犯。完善对生育权的宪法保障不仅能使我国公民的生育权得到切实保护而且能完善我国的法治建设。所以，我国政府应不断加强对公民生育权的关注，重视对公民生育权的法律保障。

Abstract
The development of human is wrapped up in birth. For all the countries in the world, thepopulation has become one of the key factors that decide the development of society.
Compared with most other countries, our country has a number of population and thepopulation rises very quickly, which determines our country has to carry out Birth Control.
However, there was lots of excited talk about the case of the forced abortion that happened inthe Ankang of Shaanxi province. The event gived an account on a fact that a pregnant womanin the Ankang of Shaanxi provice who was forced into the hospital for an abortion operationby staff of local family-planning department. It is provoked by this event, I decided to look atthis article to make an analysis and research about reproductive rights in our country. First ofall, this paper looked back the forced case occurred in Ankang of Shannxi province, andwhich was the background in writing of this article to capture the existing problems of ourcountry's reproductive rights and appeal for the establishment of constitutional protection ofreproductive rights. Secondly, this article emphasized reproductive rights is one of basichuman rights of citizens through a few arguments about the beast and meaning ofreproductive rights. Once again, this article began a further research on the evolution ofreproductive rights since the primitive society to reveal necessity of history of reproductiverights. And then this article offerd a few examples that reproductive rights' security wascurrently rife with problems. Finally, I commented on the necessity of constitutionalprotection of citizens' reproductive rights and how to build a security system of reproductiverights.
The reproductive rights is a right in the field of human rights. Goverment departmentsalso can't ignore the guarantee of citizens' reproductive rights when they require citizens tomeet their obligations of family planning, our country must adopt necessarily legal actions toensure the citizens' reproductive rights from illegal violations. Refining the constitutionalprotection of reproductive rights doesn't only give a practical protection to our citizens'
reproductive rights, but also improve the construction of legal in China. So, Chinesegoverment should show solicitude constantly for citizens' reproductive rights and take lawsafeguards for reproductive rights of citizens seriously.
