摘 要
随着我国经济的迅猛发展和房价的一路飙升,按揭房已然成为大众购房的最佳选择之一。与之相应,在离婚诉讼中因按揭房权属认定而引发的争议也逐渐增多。如何公平合理的认定按揭房权属成为了几乎与子女抚养同等重要的问题。我国《婚姻法》解释三出台几年来,为解决离婚诉讼中的诸多争议提供了法律依据,但是针对按揭房屋的权属认定及分割问题,由于其规定粗疏、操作性较差,致使按揭房权属的认定及增值部分补偿问题仍旧是司法实践中的争议焦点。无论判决还是调解离婚案件,各地法院处理按揭房权属认定纠纷时都会面临《物权法》和《婚姻法》的适用选择,物权法思维逐渐被用于解决婚姻领域财产纠纷问题,而婚姻家庭的特殊属性及婚姻法的立法精神却逐渐被忽视。不完备的不动产登记制度也是造成按揭房权属认定困难的另一个重要原因,缺少统一的不动产登记立法及登记机构,致使不动产登记市场呈现无序混乱迹象。2015 年《不动产登记暂行条例》的出台,虽然从一定程度上完善了不动产登记制度,但是由于其自身的不足与缺陷,并不能达到统一不动产登记立法之目的。因此,处理离婚诉讼中按揭房的权属认定时不应单纯强调保护个人财产,应正确处理好各部门法之间的关系,从维护家庭共同体的角度出发,尊重传统婚姻家庭理念,侧重保护妇女儿童权益,重视劳动价值,公平、合理的处理离婚诉讼中按揭房权属纠纷。
本文通过案例引发的思考,分析导致司法实践中认定按揭房权属困难的原因,通过比对实践中按揭房权属认定的不同观点,总结出影响其认定的核心因素:时间因素和资金因素。本文还讨论了颇具争议的按揭房增值部分法律性质及认定原则,介绍了罗马法“嫁资”制度给予笔者对于认定按揭房权属的启示,并针对如何正确认定按揭房权属问题,从离婚财产认定制度、婚前财产协议制度、引进信托制度等方面提出了立法完善及司法建议,希望对健全婚姻法体系尽自己绵薄之力。

Abstract
With the development of economy and the soaring house prices, mortgage has becomeone of the most popular choice for buyers. Accordingly, in the divorce proceedings formortgage housing ownership identification and disputes increase gradually. How fair andreasonable determination of mortgage housing ownership has become almost as importantissues and child raising. The third interpretation of marriage law provides the legal basis forsolving the disputes in divorce proceedings.But according to the mortgage house ownershipidentification and segmentation problem, due to the provisions of careless, poormaneuverability, identified the mortgage housing ownership and value-added part of thecompensation problem is still the focus of controversy in the judicial practice.Application ofmortgage housing ownership around the court dispute will face the Property Law and theMarriage Law, the property law has been used to solve the thinking of marriage propertydisputes.But the marriage and family in the special property and marriage law legislationspirit has gradually been neglected. Not complete the registration system of real estatemortgage housing ownership identification is another important reason for difficult, real estateregistration legislation and registration institution resulting in the lack of a unified registrationof real estate market disorder, Interim Regulation on Real Estate Registration promulgated ina certain extent and improve the real estate registration system, but because of its ownshortcomings and defects, and can not be a unified real estate registration legislation purpose.
Therefore, in the divorce mortgage housing ownership dispute should not simply focus on theprotection of personal property, we should correctly handle the relations between the lawdepartment, from the point of view of the maintenance of family community point of view, torespect the traditional marriage and family concept, focus on the protection of women's rightsand interests, pay attention to the value of labor.We should be fair, rational treatment ofhousing mortgage in divorce proceedings ownership dispute.
Reflections on case, analysis of the causes of judicial practice that the mortgage right isdifficult.Through the comparison of different points of view in the practice of mortgagehousing ownership identification, summed up the impact of the core factors identified factors:
time and money.This paper also discusses the legal nature and the principles for determiningthe controversial housing mortgage value-added part, introduces the method of Rometrousseau system to give the cognizance of the mortgage right is a revelation.In order tocorrectly identify the mortgage housing ownership, divorce property identification from theproposed legislation and justice system, pre marital property agreement system, theintroduction of the trust system, we hope to improve the system of marriage law to make itsown modest.
