摘 要：百年老字号被抢注、中药发展困难重重、近千年历史的皮影戏濒临灭绝，以中国为代表的传统文化大国对传统文化保护担忧的解决之道被集中在了传统文化的知识产权保护之上。本文以传统文化特征与知识产权特征的契合性研究为中心，分五部分对传统文化知识产权保护的基本法律问题进行探究。
第一部分主要是对国内外研究传统文化知识产权保护的综述，并对于本文的写作目的及意义、方法等进行阐述；第二部分主要介绍了传统文化的概念和特征，并在 WIPO给出的传统文化概念的基础之上结合传统文化的几项基本特征给出了知识产权语境下传统文化的概念；第三部分主要探讨传统文化知识产权保护的基本法律特征，其中以知识产权的时间性、专有性和地域性特征为比照对象，将传统文化所具有的特质与上述三个特征进行比照，发现其中的契合点与不符点；第四部分以知识产权制度的发展历史和理论依据为出发点，论证传统文化知识产权保护的可能性，并在此基础之上得出基本结论；第五部分着重研究了国际组织以及其他国家对传统文化保护的方式，并在此基础之上对我国传统文化知识产权保护的路径提出了建议。
传统文化贵在传承和发扬，完全的私权保护或是不保护都不可取，以传承价值为首要价值同时以知识产权制度为载体保护传统文化之上的经济利益才能使传统文化保护更有意义。

Abstract：Often seeing the scenes: time-honored brands registered by others, traditional Chinesemedicine developing in dilemma and the shadow play for near one- thousand- year history onthe brink of extinction, China, as the representative of traditional cultural powers, focuses onthe intellectual property protection as the solution to the protection of traditional culture. Thisarticle concentrates on the research between the characteristics of traditional culture andintellectual property, divided into five parts to study the laws of intellectual property fortraditional culture.
The first part is the overview of intellectual property protection of traditional culture athome and abroad, and for the purpose of writing this paper and the significance, methods andso on.
The second part mainly introduces the concept and features of the traditional culture,and on the basis of WIPO given by traditional culture concept gives some basic features ofthe traditional culture of the concept intellectual property of traditional culture context.
The third part mainly discusses the basic legal characteristics of intellectual propertyprotection of traditional culture, the intellectual property rights, exclusive and regionalcharacteristics as comparison object, will have the characteristics of the traditional cultureand the three characteristics are compared, find the conjunction point with discrepancies.
The fourth part of the development history and theoretical basis of the intellectualproperty system as the starting point, demonstrate the possibility of traditional culture and theprotection of intellectual property rights, and on the basis of the fundamental conclusions.
The fifth part focuses on the study of international organizations and other countries onthe protection of traditional culture, and puts forward the suggestions on the basis of thetraditional culture of intellectual property rights to protect our path.
Traditional culture treasures in inheriting and carrying forward. Complete private rightprotection or unprotection is undesirable. Only the economic interest based on inheritance asprimary value as well as intellectual property institution as carrier to protect traditionalculture can make sense.
